Liverpool John Moores University Students’ Union (JMSU)
Election Candidates Terms and Conditions 2024
Candidates must sign the following declaration and disclose any pertinent information, ensuring that they are not disqualified in any of the following ways:
- As a Trustee (section 1)
- Through their relationship with the Liverpool John Moores University (section 2)
- Through their relationship with John Moores Students’ Union (section 3)
- Other terms (section 4)
You will only be able to nominate yourself for one officer role.
Section 1: As a Trustee
In line with the General Data Protection Regulation (GDPR) you are required to give express consent to the following Terms and Conditions. If consent is not given for any reason then you will not be able to stand as a candidate in this election.
- You will only be able to nominate yourself for one officer role.
- All elected Full-Time Officers are members of the Trustee Board. You should be aware that you may be ineligible to be a trustee if:
- You are under 18 years of age
- You have been convicted of any of the following offences, which are not regarded as legally spent:
- an offence involving deception or dishonesty
- a terrorism offence:
- to which Part 4 of the Counter-Terrorism Act 2008 applies
- under sections 13 or 19 of the Terrorism Act 2000
- a money laundering offence within the meaning of section 415 of the Proceeds of Crime Act 2002
- a bribery offence under sections 1, 2, 6 or 7 of the Bribery Act 2010
- an offence of contravening a Commission Order or Direction under section 77 of the Charities Act 2011
- an offence of misconduct in public office, perjury or perverting the course of justice
- relation to the above offences, an offence of: attempt, conspiracy, or incitement to commit the offence; aiding, or abetting, counselling or procuring the commission of the offence; or, under Part 2 of the Serious Crime Act 2007(encouraging or assisting) in relation to the offence:
- You are on the sex offenders register (i.e. subject to notification requirements of Part 2 of the Sexual Offences Act 2003)
- You have an unspent sanction for contempt of court for making, or causing to be made, a false statement or for making , or causing to be made, a false statement in a document verified by a statement of truth
- You have been found guilty of disobedience to an order or direction of the Commission under section 336(1) of the Charities Act 2011.
- You are a designated person for the purposes of Part 1 of the Terrorist Asset Freezing etc. Act 2010, or the Al Qaida (Asset Freezing) Regulations 2011.
- You have previously been removed as an officer, agent or employee of a charity by the Charity Commission, the Scottish charity regulator, or the High Court due to misconduct or mismanagement
- You have previously been removed as a trustee of a charity by the Charity Commission, the Scottish charity regulator, or the High Court due to misconduct or mismanagement
- have been removed from management or control of anybody under section s34(5)(e) of the Charities and Trustee Investment (Scotland) Act 2005 (or earlier legislation)
- You are disqualified from being a company director, or have given a disqualification undertaking, and leave has not been granted (as described in section 180 of the Charities Act) for you to act as director of the charity
- are currently declared bankrupt (or subject to bankruptcy restrictions or an interim order)
- You have an individual voluntary arrangement (IVA) to pay off debts with creditors
- You are subject to a moratorium period under a debt relief order, or a debt relief restrictions order, or an interim order
- You are subject to an order made under s.429(2) of the Insolvency Act 1986. (Failure to pay under a County Court Administration Order.)
- Your digital footprint displays behaviour and attitudes that contravene the mission and values of John Moores Students’ Union. This might include but is not limited to offensive remarks or comments made at any point in time on any social media platform or forum on the internet that would be offensive to any LJMU student.
- If you are ineligible to be a Trustee your candidacy will not be valid. If you have any questions about being a Trustee please email elections@ljmu.ac.uk
Section 2: Relationship with the Liverpool John Moores University
- Between election and taking up office you must be a registered student and abide by the University’s disciplinary regulations and codes of conduct. To ensure that your registration and compliance is sound we ask that you declare to JMSU any outstanding or concluded issues with the Liverpool John Moores University. Any disclosure will be treated in the strictest confidence. For the avoidance of doubt you may be ineligible to stand as a candidate in JMSU if you have issues relating to reasons listed below, but not necessarily limited to:
- Academic Misconduct (for example cheating in exams, collusion, plagiarism)
- Attendance
- Outstanding debts to the university in relation to tuition fees
- Student discipline
Section 3: Relationship with John Moores Students’ Union
- By submitting your nomination you confirm that you are:
- not presently under disciplinary or sanctions that have arisen from a Complaints process through JMSU.
- not presently under any sanctions for disciplinary or misconduct with any external governing bodies or organisations that would impact your role with JMSU.
Section 4: Other Terms
- By submitting your nomination you are also agreeing to the following:
- That JMSU will use your written statement, campaign poster (where applicable), printed/electronic photo and other material relating to your candidacy to promote or publicise the election. Publication may be through printed materials, social media and the JMSU website.
- That JMSU will give your contact details (Name, position nominated for and email address) and written statements or visual manifestos to relevant JMSU media group representatives for the purpose of assisting media groups’ organisation of election media days and additional coverage they may wish to provide. Media groups include, but may not be limited to: Loopervil – Student Radio Station.
- Candidate Equality Monitoring forms will be used for the purposes of monitoring/reporting the diversity of election candidates, and for monitoring the diversity of members appointed to the Trustee Board. This information is not shared with external organisations (including LJMU). NUS may collect this information via survey on behalf of JMSU.
- Candidates are able to withdraw themselves from the election at any time. Where a candidate wishes to withdraw themselves following the close of nominations, JMSU will only do this with written notification from the candidate. If a candidate wishes to withdraw they should contact elections@ljmu.ac.uk .
- Candidates’ faces and names may still appear on JMSU printed/electronic materials where a candidate withdraws after the materials have gone to print using an external organisation. This is something that JMSU cannot control. JMSU will not be able to remove information from materials that have already been published.
